Privacy Policy

This Privacy Policy describes how Vertical Aspect, LLC ("Vertical Aspect," "we," "us," or "our") collects, uses, and shares personal information in connection with our website, dashboard, and cloud-based aerial data management and analytics platform (collectively, the "Services").

The Services are provided from the United States and are directed to users in the United States and Canada. They are not currently directed to individuals in the European Economic Area (EEA) or the United Kingdom. The GDPR-related provisions of this Policy apply only if and to the extent the GDPR nonetheless applies to a particular processing activity.

1. Our Role: Controller vs. Processor

We act in two distinct capacities:

As a controller, we are responsible for personal information we collect directly — for example, account registration details, billing information, website analytics, and marketing data. This Policy primarily addresses that processing.

As a processor / service provider, we process data that our customers upload to or collect through the platform — including aerial imagery, photogrammetry outputs, flight telemetry, and GPS data ("Customer Content") — on behalf of and under the instructions of the customer. Aerial imagery may incidentally capture identifiable individuals, vehicles, or private property. The customer is the controller of that data and is responsible for its lawful collection and for responding to related privacy requests; we support customers in fulfilling those obligations. If your personal information appears in Customer Content, please direct requests to the organization that collected it.

In addition, as permitted by our Terms of Service, we use Customer Content to develop, train, and improve our machine learning models and processing technology, and may use Customer Content in our marketing materials. To the extent Customer Content contains personal information, we act as an independent controller for these uses. Customers may opt out of these uses at any time by written notice to info@verticalaspect.com, as described in our Terms of Service.

2. Personal Information We Collect

Information you provide

Account and profile data (name, email address, phone number, company, job title, password); billing data (billing address and payment details, which are processed by our third-party payment processor — we do not store full payment card numbers); communications (support requests, sales inquiries, feedback); and content you submit through forms or events.

Information collected automatically

Usage data (features used, projects and processing jobs run, pages viewed, timestamps); device and log data (IP address, browser type, operating system, device identifiers); and cookies and similar technologies as described in Section 8.

Customer Content

Imagery, video, flight logs, telemetry, GPS coordinates, mission plans, and derived outputs (orthomosaics, 3D models, volumetric measurements) uploaded to or generated by the platform, processed as described in Section 1.

Information from third parties

We may receive information from integrated drone hardware providers, resellers, payment processors, and business contact enrichment or analytics providers.

3. How We Use Personal Information

We use personal information to: provide, operate, secure, and maintain the Services; process photogrammetry jobs and deliver outputs; set up and manage accounts and subscriptions; process payments; provide support and respond to inquiries; send service, security, and administrative communications; send marketing communications where permitted (you may opt out at any time); monitor, analyze, and improve the Services, including in aggregated or de-identified form; develop, train, test, and improve our machine learning models, photogrammetry processing, and analytics; create marketing and promotional materials, including sample imagery and case studies; detect, prevent, and investigate security incidents, fraud, and abuse; and comply with legal obligations.

4. Legal Bases for Processing (if the GDPR applies)

Although the Services are not currently directed to the EEA or UK, if the EU or UK General Data Protection Regulation ("GDPR") applies to a particular processing activity, we process personal information on the following legal bases: performance of a contract (providing the Services and managing your account); legitimate interests (securing and improving the Services, training and improving our machine learning models, B2B marketing, fraud prevention), balanced against your rights; consent (where required, such as certain cookies or marketing — you may withdraw consent at any time); and legal obligation (tax, accounting, and regulatory compliance).

5. How We Share Personal Information

We do not sell personal information, and we do not share it for cross-context behavioral advertising. We share personal information only with:

Service providers / subprocessors that help us operate the Services under contractual confidentiality and data protection obligations — including Amazon Web Services (cloud hosting and photogrammetry processing infrastructure, hosted in the United States), payment processors, email and communications providers, and analytics providers;

Your organization — if you use the Services under an account administered by your employer or another entity, that entity may access data associated with the account;

Professional advisors (lawyers, auditors, insurers) where necessary;

Authorities where required by law, legal process, or to protect rights, safety, or the integrity of the Services; and

Successors in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

6. International Data Transfers

We are based in the United States and process data on servers located in the United States. If you access the Services from the European Economic Area, the United Kingdom, Canada, or elsewhere, your personal information will be transferred to the United States. Where required, we rely on appropriate safeguards for such transfers, including the European Commission's Standard Contractual Clauses (and the UK Addendum) and, for customers, our Data Processing Addendum, available on request at info@verticalaspect.com.

7. Data Retention

We retain personal information for as long as needed to provide the Services and for legitimate business purposes such as legal compliance, dispute resolution, and enforcing agreements. Account data is retained for the life of the account and a reasonable period thereafter. Customer Content is retained according to the customer's instructions and subscription terms; following termination, Customer Content is available for export for 30 days and then scheduled for deletion, except where retention is required by law, the data has been de-identified, or the data has been incorporated into machine learning model training as described in Section 1.

8. Cookies and Similar Technologies

We use cookies and similar technologies that are strictly necessary for the Services (authentication, security, session management), and, with your consent where required, functional and analytics cookies to understand usage and improve the platform. You can control cookies through your browser settings and, where presented, our cookie banner. Because we do not use cookies for cross-context behavioral advertising, we do not respond differently to "Do Not Track" signals, but we honor Global Privacy Control signals where legally required.

9. Security

We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and infrastructure hosted on AWS. No system is completely secure; please use a strong, unique password and notify us immediately of any suspected unauthorized access at info@verticalaspect.com.

10. Your Rights and Choices

All users

You may access and update account information through your account settings, opt out of marketing emails via the unsubscribe link, and contact us at info@verticalaspect.com with any privacy request. We will respond as required by applicable law and may need to verify your identity.

United States (California and other state privacy laws)

Depending on your state of residence, you may have the right to: know/access the personal information we hold about you; correct inaccurate information; delete your personal information; obtain a portable copy; and not receive discriminatory treatment for exercising these rights. We do not sell personal information or share it for targeted advertising, and we have not done so in the preceding 12 months; accordingly, we do not offer an opt-out because none is needed. We do not use or disclose sensitive personal information for purposes requiring a right to limit. You may submit requests to info@verticalaspect.com. You may designate an authorized agent to act on your behalf; we may require proof of authorization. If we deny your request, you may appeal by replying to our decision.

The categories of personal information we collect are described in Section 2; the purposes in Section 3; and the categories of recipients in Section 5. We retain each category as described in Section 7.

European Economic Area and United Kingdom (if the GDPR applies)

If the GDPR applies to our processing of your personal information, you have the right to access, rectify, erase, restrict, and object to processing of your personal information, the right to data portability, and the right to withdraw consent at any time without affecting prior processing. Where we rely on legitimate interests, you may object based on your particular situation. You also have the right to lodge a complaint with your local supervisory authority, though we would appreciate the chance to address your concerns first.

Canada (PIPEDA and provincial laws)

You have the right to access personal information we hold about you, challenge its accuracy and completeness, and have it amended as appropriate. You may withdraw consent to our collection, use, or disclosure of your personal information, subject to legal and contractual restrictions and reasonable notice. You may direct questions or challenges concerning our compliance to our privacy contact below, and you have the right to complain to the Office of the Privacy Commissioner of Canada.

11. Children

The Services are intended for business, governmental, and professional users and are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will delete it.

12. Third-Party Sites and Services

The Services may link to or interoperate with third-party websites, drone hardware, and services. Their privacy practices are governed by their own policies, which we encourage you to review.

13. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will notify you by email or through the Services before the changes take effect and update the effective date above.
